Counterfeit listing triage: what to do in the first 48 hours

Finding the listing is the easy part. The work is collecting evidence that survives a platform review, moving through the right enforcement path, and noticing the sellers who come back under a new name.

Hours 0 to 6: freeze the evidence

• Screenshot everything with the URL visible: listing page, seller page, price, and the date. Store them together, not in a chat thread.
• Capture the raw page or archive it externally. Listings change and disappear, and screenshots alone are weak.
• Record the identifiers: ASIN, seller ID or store name, price, shipping origin, and the product images used. The reuse of your images is often the cleanest proof.
• Note the specifics that indicate counterfeiting: wrong packaging, mismatched labels, missing batch codes, or a price below your floor.

Hours 6 to 24: work the platform path

• Amazon: Brand Registry gives you the strongest tools, including transparency and report abuse. Without registration, enforcement is slower and weaker.
• eBay: the VERO program is the rights owner path. Non-members are stuck with general reports.
• Etsy and others: use the intellectual property reporting form and attach the evidence pack, not just a link.
• Test purchases are sometimes worth it for repeat offenders, but only when you can store and document the item properly. That is usually a counsel decision.

Day 2: think in sellers, not listings

The same seller often runs several listings, and takedown one listing at a time is a treadmill. Track seller IDs across takedowns, and watch for re-listing under new names. A simple spreadsheet with seller IDs, dates, and outcomes tells you within a month whether you are winning.

Prevention beats takedowns

• Register your brand where the platforms require it. Enforcement without registration is an uphill fight.
• Watch your product images and copy on marketplaces; reuse is the earliest signal.
• Monitor certificate transparency for lookalike domains and phishing pages built on your name.
• Keep one evidence folder per brand, so a paralegal or agency can act without you redoing the research.
